Under the instructions of my client Sri. Pagadala Bharath, S/o Lingaiah, Age: 27 years, Occu: Business, R/o H.No.6-58, Gumpala (V), Chivvemula (M), Suryapet District, I do hereby give you the following notice for your immediate compliance.

1. According to my client, my client is the owner of the Maruti S-Presso VXI+BSVI Car bearing No.TS 29 J-7892 and he was engaged with your company on a monthly rent of 13-03-2022 through a Lease Agreement executed in between my client and you No.1 & 2. Your authorities used to book the car through online (Self Drive Booking) and used to pay 70% of booking amount to my client or Rs.30,000/- per month if no booking happened.

2. While so, on 13-06-2022 your authorities booked the car through online and my client handed over the same to your customer. While the car was Party’s customer. While the car was under the Opp. Party engagement with the Opp. Party’s customer, it was met with a road accident and badly damaged. Immediately the Opp. Party’s authorities put the said car in Mrugon Motors, Kukatpalli, Hyderabad for repairs. After keeping the said car for months together, later on 05-05-2023 it was shifted to SK Motors, Bandlaguda, Hyderabad wherein the said car was also kept as idol without attending repairs, on the reason that the Opp. Party authorities did not paying the previous repair amounts to them.

4. It is further submitted that, due to such acts of the Opp. Party authorities, the complainant’s vehicle becomes an idol without in use for a period of more than one year. In this regard the complainant many times requested the Opp. Party to get complete its repair and hand over the vehicle to him, but the Opp. Party have been dodging the matter on one pretext or the other, which is nothing but deficiency of service on the part of the Opp. Parties. Having vexed with the evasive attitude of the Opp. Parties, the complainant got issued a legal notice to them on 08-07-2023. The Opp. Party No.1 acknowledged the same and the Opp. party No.2 got returned the said cover. Despite of having knowledge of the same, the Opp Parties did not choose to come forward settle the claim. As such, the complainant has no other option except to approach the Hon’ble Forum for justice. Hence this complaint.

That the complainant is claiming to get his car in a good condition or its value of Rs.5,50,000/- together with rental arrears @ Rs.30,000/- per month from the date of engagement i.e., 13-06-2022 to 12-09-2023 i.e., Rs.4,50,000/-, together with interest @24% p.a. on Rs.30,000/- from 13-06- 2022 till its realization, apart from Rs.2,00,000/- towards damages for causing mental and physical agony to the complainant.

That the Opp. Party No.2’s office is located at Kavuri Hills, Madhapur, Hyderabad -533031, Telangana State and the said car also plied at Hyderabad, as such the Hon’ble Forum has got both pecuniary and territorial jurisdiction to entertain the complainThe complaint is filed within the period of limitation.

7. 8. That on a claim of Rs.5,50,000/- + rental arrears of Rs.4,50,000/-, in total Rs. 10,00,000/- a fixed court fee of Rs. is paid vide DD

Therefore, it is prayed that the Hon’ble Forum may be pleased to pass an order in favour of the complainant and against the person and assets of the opposite parties, as under:-

a) To direct the opposite parties to hand over the said Maruti S- Presso VXI+BSVI Car bearing No.TS 29 J-7892 in a good condition or to pay the cost of the said vehicle i.e., Rs.5,50,000/- to the complainant

b) To direct the Opp. Parties to pay due rental arrears @ Rs.30,000/- per month from the date of engagement i.e., 13-06- 2022 to 12-09-2023 i.e., Rs.4,50,000/- together with interest @ 24% p.a. on Rs.30,000/- from 13-06-2022 to till its realization to the complainant.

b) Apart from Rs.2,00,000/- towards damages causing physical and mental agony to the complainant.

c) To award costs of the complaint and

d) To grant any other relief or relief’s for which the complainant entitle and the Hon’ble Forum deem fit and proper in the circumstance of the case, in the interest of justice.
